By providing your mobile phone number to Peaks Curative, LLC (“Peaks Curative, LLC”, “we”, “us”, or “our”) and explicitly opting in—such as by submitting a medical intake form or replying “YES” to begin a consultation —you expressly consent to receive automated transactional, clinical, and informational text messages (SMS) from Peaks Curative, LLC and its affiliated independent healthcare providers.
These messages are an integral part of our telemedicine platform and the E-MED EHR system, designed to facilitate your patient journey, prescription approvals, and medical follow-ups.
2. Types of Messages You Will Receive
By opting into our SMS program, you agree to receive text messages related to your medical care, which may include:
- Consultation Status Updates: Notifications such as your Visit ID creation, prescriber assignment, and requests to proceed with your consultation.
- Clinical Questionnaires: Direct questions from your assigned provider regarding your medical history, target goals (e.g., weight loss targets), or medication efficacy.
- Prescription Approvals: Alerts confirming that your prescription has been approved by the prescriber and sent to your pharmacy of choice.
- Follow-Up Care: Automated check-ins, such as a 30-day follow-up to evaluate your progress and ensure your well-being.
3. Opting Out (Cancellation)
You may opt out of receiving SMS messages from Peaks Curative, LLC at any time. To stop receiving text messages, simply reply “STOP”, “QUIT”, “CANCEL”, “OPT-OUT”, or “UNSUBSCRIBE” to any message you receive from us.
After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. Please note: Opting out of SMS communications may impact our ability to provide telemedicine services or process your prescription requests efficiently, as our asynchronous consultations rely heavily on this communication channel.

5. Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. You are solely responsible for any such charges billed by your wireless carrier.
6. Message Frequency
Message frequency will vary based on your interaction with our platform and the specific medical treatment you are seeking. You will typically receive messages only when there is an active consultation, a prescription update, or a scheduled clinical follow-up.
7. Privacy and Security Limitations (HIPAA)
While Peaks Curative, LLC operates a highly secure, HIPAA-compliant E-MED EHR infrastructure, standard text messaging (SMS) is an unencrypted communication channel. By electing to communicate with your medical provider via SMS, you acknowledge and accept that there is an inherent risk that third parties could intercept, access, or view your Protected Health Information (PHI) stored on or transmitted to your mobile device. 8. Carrier Liability
Wireless carriers are not liable for delayed or undelivered messages.
